Bookday is a software platform that helps studios, teachers and other businesses manage schedules, bookings, members and payments.
The Bookday service is provided by Bookday, Inc. and Bookday Company SASU, RCS Paris 989 097 449. The entity applicable to each studio is identified in its subscription, invoice, order or other contractual documentation.
Users must provide accurate information, keep access links and credentials secure, and use Bookday lawfully. Users may not attempt to disrupt the service, access another account without authorization, introduce malicious code, scrape protected areas, or use Bookday to infringe third-party rights.
A studio is responsible for its administrators, its content, the configuration of its services and the lawful use of member data. Bookday may suspend access when reasonably necessary to protect the service, other users or comply with law.
The studio, not Bookday, provides and sells the classes, appointments, packages, memberships or other activities shown on its booking page. The contract for those services is concluded directly between the member and the studio.
Prices, taxes, cancellation rules, refunds, validity periods, withdrawal rights and any consumer-mediation information are set by the studio and must be communicated by it. Questions or disputes about a studio service should first be addressed to that studio.
Payments are handled by the payment provider displayed during checkout. Bookday does not store full payment-card details.
A studio's plan, price, billing period, taxes and any trial or commitment period are those shown when the studio subscribes or agreed in writing. Unless otherwise stated, recurring subscriptions continue until cancelled and remain payable for the current billing period. Cancellation stops future renewals but does not retroactively refund an already-started period, except where required by law or expressly agreed.
Bookday aims to provide a reliable service, but maintenance, provider outages and technical incidents may occur. Bookday does not guarantee uninterrupted or error-free operation and is not responsible for the quality, safety, legality, cancellation or performance of services supplied by a studio.
To the extent permitted by law, Bookday is not liable for indirect loss, loss of profit, loss of opportunity or consequences caused by a studio's content or decisions. Nothing in these terms excludes liability that cannot lawfully be excluded.
Personal data is handled as described in the Privacy Policy. Studios are responsible for the purposes for which they collect and use their members' data; Bookday provides the technical platform.
The Bookday software, brand, designs, domains and related content are owned by Bookday, Inc. Bookday Company SASU operates the service under licence from Bookday, Inc. No intellectual-property right is transferred to users except the limited right to use the service during their authorized access.
Studios retain responsibility for and rights in the content they upload, and grant Bookday the limited permission necessary to host, display and process it to provide the service.
Bookday may update the service and these terms. Material changes will be notified through the platform or by email where appropriate. A user may stop using Bookday at any time, subject to outstanding payments and the studio subscription conditions. Sections intended to survive termination, including intellectual property, liability and payment obligations, remain effective.
Contracts with Bookday Company SASU are governed by French law and disputes fall under the competent courts of Paris, subject to mandatory consumer rules. Contracts with Bookday, Inc. are governed by Delaware law and disputes fall under the competent courts in Delaware, subject to any mandatory protections applicable to the user.
